Terms and Conditions of Sale — Bayt Noor

Article 1 – Purpose and Scope
These Terms and Conditions of Sale ("Terms") govern all sales made through the website baytnoor.shop (the "Website"), operated by Bayt Noor, whose registered office is located at:
2 Rue Charles Gilles, 37000 Tours, France.
By placing an order through the Website, the customer acknowledges that they have read, understood, and accepted these Terms without reservation.
Article 2 – Products
Bayt Noor offers decorative wall art and home décor products printed on demand after an order has been placed.
Product photographs and descriptions displayed on the Website are as accurate as possible. However, slight variations may occur between the images shown online and the final product, particularly due to differences in screen displays and color settings.
Article 3 – Prices
All prices are displayed in euros (€) and include all applicable taxes (VAT where applicable), excluding shipping costs where applicable.
Bayt Noor reserves the right to modify its prices at any time. However, the price charged will be the one in effect at the time the order is confirmed.
Article 4 – Orders
Orders are confirmed once the customer has accepted these Terms and completed full payment.
A confirmation email will be sent to the email address provided during checkout.
Bayt Noor reserves the right to refuse or cancel any order from a customer with whom there is an unresolved dispute relating to a previous order or payment.
Article 5 – Payment
Payment is due in full at the time the order is placed.
Payments are processed securely by credit or debit card through Shopify Payments.
Payment information is encrypted and is never stored on Bayt Noor's servers.
Article 6 – Production and Delivery
Each product is manufactured on demand after the order has been confirmed.
Production times, estimated delivery times, shipping destinations, and other shipping information are detailed in our Shipping Policy.
Article 7 – Right of Withdrawal
In accordance with Article L221-18 of the French Consumer Code and applicable European consumer protection laws, customers have the right to withdraw from their purchase within 14 days of receiving their order, without providing any reason and without incurring any penalty.
Exception – Personalized Products
In accordance with Article L221-28 of the French Consumer Code, the statutory right of withdrawal does not apply to products made according to the customer's specifications or clearly personalized (for example, products featuring a custom name, text, or dedication).
Such products cannot be cancelled or returned unless they are defective or do not conform to the order.
To exercise the right of withdrawal for eligible non-personalized products, customers must notify us within the legal withdrawal period by emailing:
Returned products must be sent back in their original condition.
Article 8 – Refunds
Where a withdrawal request is valid or where a product is defective or non-conforming, Bayt Noor will issue a refund using the original payment method within a maximum of 14 days after receiving the returned product or proof that it has been shipped back.
Article 9 – Legal Guarantees
All products sold through the Website benefit from the legal guarantee of conformity provided under Articles L217-3 and following of the French Consumer Code, as well as the legal warranty against hidden defects under Articles 1641 and following of the French Civil Code.
These statutory rights apply in addition to any other rights available under applicable consumer protection laws.
Article 10 – Liability
Bayt Noor shall not be held liable for damage resulting from improper use of the purchased products.
Bayt Noor shall also not be liable for delays or failure to perform its obligations due to events beyond its reasonable control, including force majeure, postal disruptions, transportation delays, strikes, or other unforeseen circumstances.
Article 11 – Personal Data
The processing of customers' personal data is governed by our Privacy Policy and complies with the General Data Protection Regulation (GDPR) and applicable data protection laws.
Article 12 – Governing Law and Jurisdiction
These Terms are governed by the laws of France.
In the event of a dispute, and after an attempt has been made to reach an amicable resolution, the French courts shall have exclusive jurisdiction, unless mandatory consumer protection laws provide otherwise.
